最高法院上午開庭辯論，鄭捷面無表情。他的辯護律師稱讚最高法院提訊被告，是對生命權的尊重及保障正當法律程序。他們批評原審訴訟程序、證據能力有瑕疵，判處死刑是違法。檢察官則一一反駁。

本案爭議點包括，原審認為台大醫院精神鑑定報告有證據能力，有無違法、鄭捷在偵查中沒有律師協助，是否違法、原審判處死刑是否違法或不當等。

由於最高法院是法律審，過去生死辯從未提訊被告。本案受命法官黃瑞華根據兩公約等，認為應給被告到場聽審和陳述意見權利，因此打破慣例提訊鄭捷，創下最高法院首例。
